        McCHESNEY & DALE, P.C., renders employee benefit services to corporations, private professionals, closely-held businesses, and large multi-employer trust funds. Pension, welfare, profit sharing, 401(k) and 403(b) plans are some of the qualified employee benefits plans the firm designs and implements. It also represents trustees/administrators before various governmental regulatory agencies.

        Assistance in ERISA matters is a primary focus area of the firm. ERISA is the Employee Retirement and Income Security Act of 1974, a federal law which covers all employee benefit plans.  The firm has been actively involved in the field of retirement benefits and health care law since the passage of ERISA in 1974. This includes preparing, qualifying, amending, and terminating plans, executing prohibited transaction exemptions, providing advice regarding fiduciary duties, drafting investment manager contracts, and overseeing administrative and regulatory compliance. We regularly attend client trustee meetings.  We are actively involved in defending and prosecuting employee benefit claims administratively and through the courts.

        Members of the firm regularly monitor the ever developing area of employee benefits law in order to keep clients appraised of the most recent changes, and they are available to meet with clients to discuss the impact of recent legal developments and implement any warranted changes.

        In addition, the firm has extensive experience in litigating ERISA claims, including medical benefits, pensions and long term disability benefits. Successful claims have been achieved for individuals disabled by such conditions as orthopedic injuries, chronic fatigue syndrome, multiple chemical sensitivities and other long term disabilities.
